Agreement Substance

The theoretical mystery of why States generally do not provide for compensation mechanisms as part of their international agreements remains to be explained. 183 For another perspective in this issue on the effectiveness of non-binding agreements, see Mirmina, Steven A., Reducing the Proliferation of Orbital Debris: Alternatives to a Legally Binding Instrument, 99 AJIL 649 (2005)CrossRefGoogle Scholar. 116 Domestic preferences are asymmetrical in another dimension. There are always national actors who oppose cooperation, as well as those who prefer them. Those who prefer a new agreement to the status quo (which cannot or cannot be an agreement) usually demand a contract. It does not follow, however, that national actors who prefer the status quo are demanding commitments. On the contrary, there are three relevant possibilities: commitments, contracts and not an agreement.
